Published in full, including what overruns cost.
One rate for all mediation matters, whatever the subject. Every figure is on this page, and none of it has to be asked for. All fees are plus HST.
Mediation
Half day or full day.
One rate for every matter. Preparation is bundled into the fee and is capped.
- Half day — up to 3 hours of session Fee includes up to 2 hours of preparation.

Arbitration
Hourly, by hearing day, or flat.
Sole, party-appointed and co-arbitration appointments, in commercial matters.

- Documents-only or expedited — simple Flat fee, agreed in the first procedural order.

- Documents-only or expedited — complex Flat fee. Which band applies is settled before the appointment.

Family arbitration under the Family Law Act is not offered, and family law matters are not accepted.

Charged hourly, with an estimate agreed in the terms of appointment.
- Early neutral evaluation A reasoned assessment of the merits, delivered to both parties together. Never advice to one of them.

- Dispute-system design Advising an organisation on how its future disputes should be handled, before there are any.

- Pre-dispute technical advisory Technical review before a dispute exists. Taking it on can rule me out of a later appointment in the same matter, and that is settled in writing before the work starts.

Cancellation
If a date is cancelled.
A reserved date is time that cannot be given to another matter. The schedule is published so it is never a surprise.
- More than 30 days before
- No fee. Disbursements only.
- 15 to 30 days before
- 50% of the booked fee.
- Fewer than 15 days before
- 100% of the booked fee.
- Rescheduling at the time of cancellation, with a new date fixed, is not charged.
- The cancellation fee is waived if the reserved time is filled by another matter of equal or greater value.
Terms
How the account works.
- All fees are plus HST.
- Fees are shared equally between the parties unless they agree otherwise in writing.
- Accounts are payable on rendering. Interest accrues on overdue accounts at 5% per annum.
- Video and in-person sessions are charged at the same rate.
- Travel outside the Greater Toronto Area is billed separately, or bundled at a day rate stated in the terms of appointment.
- Everything above is confirmed in the terms of appointment before an engagement begins. Nothing on this page is an appointment.
